Welcome to Wist (“App”), provided by Syft Health Ltd (“Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of the App and any related services. By accessing or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. About Us

Syft Health Ltd is a company registered in England and Wales with company number 14156327 and registered office at 27 Mortimer Street, London, England, W1T 3BL.

2. Use of the App

You must be at least 16 years old to use Wist. By using the App, you confirm that you meet this age requirement.

The App allows users to track dietary information by submitting text and images related to meals. The information provided is for informational purposes only and does not constitute medical advice.

We specifically ask during onboarding whether users have a current or past eating disorder. If you indicate that you do, you must not use the App. Wist is not appropriate for individuals with eating disorders. We accept no responsibility for any adverse effects that may arise if you use the App despite this warning.

3. Subscriptions, Free Trials, and Payments

Wist offers a 7-day free trial followed by a monthly or annual subscription.

Payments and cancellations are handled directly by the Apple App Store or Google Play Store and are subject to their terms and conditions. You are responsible for managing your subscription, including cancelling before renewal if you no longer wish to continue.

Refunds are not available outside of the policies of the app stores.

4. User Content and Confidentiality

By submitting text, images, or other content to the App (“User Content”), you grant Syft Health Ltd a non-exclusive, worldwide, royalty-free license to use, store, and process that User Content solely for the purpose of operating and improving the App.

We maintain strict confidentiality over user-submitted dietary information.
However, anonymized data — such as meal descriptions and images — may be processed by AI systems (hosted by us or our trusted providers) to improve our services.
No personally identifiable information will be included in such processing.

You are solely responsible for the accuracy and legality of your User Content.

5. Acceptable Use

You agree to use the App only for lawful purposes.
You must not:

• Upload any material that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

• Interfere with the operation of the App or attempt unauthorized access to our systems.

• Violate the intellectual property rights or privacy of others.

We reserve the right to suspend or terminate your access to the App if you violate this Acceptable Use policy.

6. Intellectual Property

All intellectual property rights in the App, including but not limited to software, AI models, designs, and trademarks, belong to Syft Health Ltd or its licensors.

You may not copy, modify, distribute, sell, or lease any part of the App without prior written permission.

7. Health Disclaimer

Wist is not a medical service.
We do not provide medical advice, diagnosis, or treatment.
You should consult a qualified healthcare provider before making any changes to your diet or health routines based on information from the App.

Your use of the App is at your own risk.

8. Limitations of Liability

To the fullest extent permitted by law, Syft Health Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

Our total liability to you for any claims under these Terms is limited to the amount you paid us (if any) in the past 12 months.

Nothing in these Terms limits your statutory rights as a consumer under the laws of England and Wales.

9. Termination

We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or otherwise use the App in a harmful manner.

You may stop using the App at any time.

10. Changes to These Terms

We may update these Terms from time to time.
If we make material changes, we will notify you by appropriate means (such as an in-app notification or email).
Your continued use of the App after such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales.
Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of England and Wales.
